Bella Vista Updates Construction Board By-Laws

BELLA VISTA, AR – The Bella Vista Board of Construction Appeals has updated its by-laws for the first time since 2010, reflecting changes in city regulations and construction practices. The amendments, approved unanimously by board members during the February 11, 2025 meeting, include revisions to Section B, Subsection 5, which outlines board procedures and decision-making processes.

The updated by-laws aim to streamline appeals procedures and clarify voting and quorum requirements, ensuring smoother operations and better accountability in construction-related decisions.

The updates include:

Membership Structure & Terms:

  • The Board consists of seven members appointed by the Mayor and approved by City Council.

  • Members must be qualified electors residing in Bella Vista and cannot hold any other municipal office.

  • Term limits remain open, allowing members to be reappointed indefinitely.

  • Election of Officers:

    • The Chairperson and Secretary are elected annually in January.

    • Officers can serve consecutive terms and are responsible for presiding over meetings, maintaining order, and handling procedural duties.

  • Meeting Rules & Procedures:

    • Regular meetings occur on the second Tuesday of each month unless there are no cases pending.

    • A quorum is set at four members, and a majority vote is required for decisions.

    • Members with a conflict of interest must leave the room during discussions and voting on related matters.

  • Appeals & Variances Process:

    • The board hears appeals from decisions made by the Fire Chief or Building Inspector regarding construction approvals.

    • Applicants can request variances if they seek modifications to standard construction requirements.

    • Appeals decisions can only be further challenged in Benton County Circuit Court.

  • Public Transparency & Record Keeping:

    • All board meetings are public, and minutes must document votes, appeals, and decisions.

    • Records are maintained at City administrative offices for public access.

These changes ensure that board procedures are up-to-date, supporting efficient review of construction appeals and variances. The revisions also emphasize public accountability, conflict-of-interest rules, and streamlined decision-making processes.

The updated by-laws took effect immediately following approval and will govern board operations moving forward.
